Distressed M&A Roundtable Breakfast Briefing22 May 2009

Drawing from their extensive restructuring experience, panelists provide an overview of the challenges and opportunities facing distressed investors today, as well as a detailed forecast for the year ahead.

Distressed M&A professionals are entering largely uncharted territory. Traditional approaches to distressed M&A are transforming in response to unprecedented market conditions and general economic uncertainty. For example, the panelists discussed how the limited access to debtor-in- possession (DIP) financing has opened the door to unconventional financing methods, while a new degree of flexibility from bankruptcy courts is changing the auction process for distressed companies. Out-of-court restructurings, loan-to-own scenarios, debt buy-backs and pre-packaged bankruptcies are further examples of increasingly common strategies distressed companies are pursuing.
